Party Participation Waiver and Release of Liability

By submitting an application or registering to attend an event organized by The Darkest Room (“Organizer”), I acknowledge and agree to the following terms and conditions, which govern my participation in all events hosted under Umbral Events and darkestroomparty.com (“Event” or “Events”). I understand that failure to comply with these terms may result in immediate removal from the event and/or permanent suspension from future participation.

1. Assumption of Risk

I understand that attendance at any Event may involve inherent risks, including but not limited to physical injury, emotional or psychological distress, and potential exposure to sexually transmitted infections or communicable diseases.
I voluntarily assume full responsibility for any such risks and for taking appropriate precautions to safeguard my personal health and wellbeing. I acknowledge that The Darkest Room and its affiliates cannot be held responsible for any harm, illness, or injury arising from my voluntary participation.

2. Consent and Personal Conduct

I understand that clear consent is required for any physical, sexual, or otherwise intimate contact.

• Consent must be freely given, and may be verbal or clearly expressed nonverbally.

• Consent can be withdrawn at any time, for any reason, and must be immediately respected.

• The mere presence of an individual at an Event, or the general nature of the event itself, does not imply consent to any interaction.

I agree to behave in a respectful, considerate, and non-coercive manner at all times. I will not engage in harassment, intimidation, or any form of non-consensual contact. I understand that any violation of these standards will result in my immediate removal from the Event and potential permanent exclusion from all future Events.

3. Confidentiality

I recognize that discretion and privacy are fundamental to participation.
I agree to maintain strict confidentiality regarding the identities, activities, and communications of all attendees, and to refrain from photographing, recording, or disclosing any information about other participants without their explicit prior consent. This confidentiality obligation survives my participation in the Event indefinitely.

4. Release of Liability

In consideration of being permitted to attend and participate in the Event, I hereby release, waive, and forever discharge The Darkest Room, its owners, affiliates, officers, directors, employees, contractors, volunteers, and representatives (collectively, the “Released Parties”) from any and all claims, demands, actions, or causes of action arising from or related to any loss, damage, injury, illness, or death that may occur as a result of my participation, including those caused by negligence, to the fullest extent permitted by law.

5. Indemnification

I agree to indemnify, defend, and hold harmless the Released Parties from any and all liabilities, costs, damages, or expenses (including reasonable attorneys’ fees) resulting from my actions, conduct, or violation of this agreement while participating in any Event.

6. Acknowledgment and Voluntary Agreement

By submitting this application or registering to attend, I acknowledge that:

• I have read and understood this Waiver and Release of Liability in its entirety.

• I am voluntarily signing it and agree to be legally bound by its terms.

• I have had the opportunity to seek independent legal advice prior to acceptance.

I fully understand that this document is intended to release The Darkest Room and its affiliates from liability to the maximum extent permitted by law.
